Key Membership Rules

By purchasing a membership, you agree to our Terms & Conditions (including our waiver requirement, which must be completed before training can begin). Memberships are personal, non-transferable, and available to individuals aged 18 and over only. Monthly memberships require 10 days’ notice to cancel, while prepaid term memberships are non-refundable and cannot be paused. Payments are taken in advance via Direct Debit or card unless otherwise stated in a prepaid agreement.

All members must check in on entry; failure to do so may breach Health & Safety rules and could result in membership termination. We operate a zero-tolerance policy towards inappropriate conduct, including harassment, disruptive behaviour, misuse of equipment, and any attempts to challenge or reprimand staff.

Members are expected to follow basic gym etiquette at all times, including re-racking weights, limiting use of cardio equipment to 20 minutes during peak times, and maintaining high standards of hygiene. Appropriate gym attire must be worn; dirty footwear, sandy shoes, and unsuitable clothing are not permitted.

Smoking, vaping, and animals (except registered service animals) are not allowed on site. Personal training is only permitted by approved trainers who are registered with the gym and have paid any applicable fees.

The gym operates with partial supervision and may be unstaffed during certain hours; members use the facility at their own risk. Filming and social media content must not include other members without consent. Filming for journaling training is permitted. Filming for promotion must be checked with us first.

Guests must have a valid guest pass before entry, must comply with all gym rules at all times, and the member is fully responsible for their guest’s behaviour and any breaches of these Terms. Their names must be registered with us.

Parking is free only while using the gym and is limited; unauthorised parking may result in a £30 daily charge.

By joining, you agree to these Terms. Your statutory rights under UK law are not affected.

1. Membership

  • Membership is personal and cannot be transferred
  • You must be 18 or over to join
  • Your membership starts when payment is confirmed

2. Payments

  • Membership fees are taken monthly in advance (unless otherwise stated)
  • Payments are non-refundable except where required by law
  • If a payment fails, your access may be paused until it is resolved
  • We may charge a reasonable admin fee for failed payments
  • Repeated missed payments may lead to suspension or cancellation

3. Cancellation

  • You can cancel monthly memberships with at least 10 days’ notice
  • Cancellation must be submitted via email or our official cancellation method
  • If notice is late, you may be charged for one additional billing period
  • Prepaid memberships cannot be paused or refunded unless required by law

4. Freezing Your Membership

  • Freezes may be available in some cases (e.g. injury or travel)
  • A freeze pauses your access but does not cancel your membership
  • Freeze approval is not automatic and must be confirmed by us in writing
  • Billing depends on your membership type and freeze agreement
  • Freezes do not replace cancellation notice

5. Access & Gym Us

  • Entry credentials are personal and must not be shared
  • You must follow gym rules and check in on entry
  • Misuse of access or unsafe behaviour may result in suspension

6. Safety & Conduct

  • You train at your own risk
  • Follow all safety instructions and use equipment properly
  • Respect staff and other members at all times
  • We may restrict access for unsafe or disruptive behaviour

7. Suspension or Ending Membership

We may suspend or end your membership if reasonably necessary, including for:

  • non-payment
  • breach of gym rules
  • misuse of access
  • unsafe or abusive behaviour

We will act fairly and proportionately.

8. CCTV & Security

  • CCTV is used for safety, security, and incident management

9. Changes to Membership or Terms

  • We may update pricing or Terms
  • We will give reasonable notice of material changes

10. Liability

  • We are not responsible for loss, theft, or injury unless caused by our negligence
  • Nothing in these Terms limits your rights under UK law

GYM WAIVER AND RELEASE OF LIABILITY

Office Gym Club – Assumption of Risk & Safety Waiver

(CMA-Aligned Consumer Agreement)

Legal notice: This waiver forms part of your membership agreement with MintFit Leisure Limited trading as Office Gym Club (“the Gym”). It does not affect your statutory rights under UK law.

By using the Gym, you confirm that you have read, understood, and agree to this waiver.

1. Nature of Participation

You acknowledge that exercise and physical training involve inherent risks, including but not limited to:

  • muscle strain or injury
  • accidents arising from equipment use
  • aggravation of existing medical conditions
  • in rare cases, serious injury

You choose to participate in physical activity at the Gym voluntarily and accept responsibility for training within your own ability.

2. Personal Responsibility

You agree that you will:

  • Use equipment safely and as intended
  • Follow reasonable instructions, signage, and gym rules
  • Not use equipment in a way that may reasonably risk harm to yourself or others
  • Take appropriate care when training in a shared environment
  • Stop exercising if you feel unwell or unsafe

You are responsible for your own training decisions and physical limits.

3. Health Confirmation

You confirm that, to the best of your knowledge, you are medically fit to participate in exercise.

If you have any medical conditions or concerns, you agree that you are responsible for seeking medical advice before using the Gym.

This waiver does not override the need for you to exercise safely and within your capabilities.

4. Gym Environment and Supervision

You understand that:

  • The Gym may be partially unsupervised at certain times
  • Staff may not always be present on the gym floor
  • You must exercise appropriate caution when using equipment and facilities

This does not affect our legal duty to take reasonable care for your safety or to maintain reasonably safe premises and equipment.

5. Liability

The Gym is not responsible for:

  • injury arising from your misuse of equipment or failure to follow instructions
  • loss or damage resulting from your own actions or negligence
  • loss or theft of personal belongings, except where caused by our failure to take reasonable care

6. Personal Property

You are responsible for your personal belongings while on the premises, including changing areas, gym floor, car park, and surrounding areas.

We are not liable for loss or theft of personal items unless caused by our negligence.

7. Conduct and Safety

You agree to:

  • behave in a way that does not endanger yourself or others
  • respect other users and staff
  • report hazards, damaged equipment, or safety concerns promptly

We may restrict access where reasonably necessary for safety, security, or rule enforcement.

8. Legal Effect

This waiver is intended to:

  • allocate responsibility for personal exercise risk
  • reinforce safe use of facilities
  • operate fairly within UK consumer protection law

It does not remove your rights under the Consumer Rights Act 2015 or other applicable UK legislation.

If any part of this waiver is found unenforceable, the remaining sections will continue to apply.
